Auction Site Terms and Conditions
General: Items are offered for sale by Vilas County. Individual(s) submitting bid offers are identified herein as “buyer(s)”.
Disclaimer: All equipment will be sold “as is,” “where is,” and “with all faults, if any.” Vilas County disclaims all warranties or guarantees, expressed or implied, as to the condition, quality, completeness or fitness for any particular or general purpose or compliance to safety regulations of the equipment being sold.
Indemnification: Bidder accepts responsibility for and agrees to indemnify, defend and hold harmless Vilas County and its employees, officers, agents, directors and representatives from and against any and all claims, losses, damages, liabilities, judgments, fees, costs and expenses (including reasonable attorneys’ fees and expenses) related to, arising from or associated with Buyer’s, his agents or representatives, use of this Site, including but not limited to personal injuries or property damage incurred on the sale premises or during removal and transport of any auction item, and arising out of, based upon, or resulting from any breach or violation by Bidder of this Site’s Terms and Conditions or any use by Bidder of the Site or as a result of a dispute with another Bidder.

Notification of Award: Award will be made to the highest responsive, responsible bidder. Notification will be provided by Vilas County via e-mail to the selected buyer.
Payment Information: Payment is required within seven (7) business days of the close of auction and no later than time of pick-up. All sales are subject to appropriate Wisconsin State Sales Tax laws. At the time of bidding, Buyer must acknowledge and agree not to retract their purchase offer.
Item Pick-Up and Ownership: Buyer shall be responsible for making all arrangements for merchandise pick-up and/or removal per specific terms or conditions listed for auction. Merchandise becomes the full responsibility of Buyer at time of PAYMENT, and Buyer assumes all risk of loss and damage to property until removed from sale premises. Winning bidders must pick up items within seven (7) business days of the close of auction, after which time Vilas County reserves the right to relist the item or award to the second highest bidder.
Method of payment accepted: personal check, Cashier’s check or money order made payable to Vilas County.
Eligibility: Minimum 18 years old and legally able to form binding contracts as a buyer.
Collusion: The Buyer certifies by entering his/her bid price that the bid is made without prior understanding or agreement with another person submitting a bid for the same item and that this bid is in all respects a bona fide and fair offer and not the result of any act of fraud or collusion with another person.
Withdrawal of Items: Despite efforts to avoid the withdrawal of item/lots from the sale after they are listed, withdrawal of items may sometimes be necessary. Vilas County reserve the right to do so at any time before or during the sale.
Award: Vilas County reserves the right to award by item, groups of items, or total bid; to reject any and all bids in whole or in part, and to waive any formality or technical defects, if in its judgment and sole discretion, the best interests of the County will be served.
Receipt: Buyer will be furnished an electronic receipt at the conclusion of the sale. Buyer must therefore provide Vilas County with Buyer’s current, correct e-mail address and/or Fax number, and/or U.S. Postal Service complete and current mailing address.
